What is a “fly away” sales tax exemption?

Fly away sales tax exemptions are exemptions that are in place in many states that say you can come and purchase an aircraft in our state, and as long as you remove it within a set period of time, we will not charge you sales tax on the transaction. Fly-aways are common, there’s a fly away in Kansas, there are fly-aways in states like Florida, and many other states across the country. What you want to be mindful of when using a fly away is some states have specific forms that you either need to execute and keep in your own records, or in the state of Florida, proactively file with the state if you intend on using the fly away exemption. What the fly away exemption is not, is an exemption of use tax on the purchase in where the aircraft is finally going to be based or used, so it’s important not to confuse the fly away sales tax exemption from a use tax exemption in your base state.
